These Terms of Service ("Terms") govern your use of the services provided by Qdos Health ("Qdos Health," "we," "us," or "our"), including our website at www.qdoshealth.com, our phone services, our user portal, and all related communications. By using any of our services, you agree to these Terms.
1. Acceptance of Terms
By calling our phone lines, visiting our website, using our user portal, sending us an email, or otherwise interacting with Qdos Health, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our services.
2. Description of Services
Qdos Health is a licensed health insurance brokerage that helps consumers find and enroll in health insurance plans. Our services include:
- Comparing health insurance plans from multiple carriers
- Medicare enrollment assistance (Medicare Advantage, Supplement, Part D)
- Small business group plan consulting
- Individual and family plan guidance
- AI-assisted insurance consultations via phone and email
- Multilingual support in English, Spanish, Chinese, Tagalog, Vietnamese, Arabic, French, Korean, Russian, Somali, Hmong, and more
We are brokers, not an insurance company. We do not issue policies, process claims, or make coverage decisions. Those functions are performed by the insurance carriers.
3. Eligibility
To use our services, you must be at least 18 years of age (or have the consent of a parent or legal guardian) and be a resident of the United States. By using our services, you represent and warrant that you meet these eligibility requirements.
4. Artificial Intelligence Disclosure
When you call Qdos Health, your call may be handled by an AI-powered voice assistant. The AI assistant:
- Is not a human. This is disclosed at the beginning of every call.
- May make errors. AI-generated information may be inaccurate, incomplete, or outdated. Always verify important insurance details with a licensed professional.
- Processes your conversations. The AI analyzes your call to provide assistance and, with your consent, stores key facts for future personalization.
You may request to speak with a human agent at any time during a call. Follow-up emails may be generated by AI and are identified as such.
5. Call Recording
All phone calls to and from Qdos Health are recorded for quality assurance unless you have opted out of call recording. You are notified of call recording at the beginning of every call. Call recordings are stored securely and subject to our data retention policy.
6. Your Responsibilities
When using our services, you agree to:
- Provide accurate and truthful information
- Not misrepresent your identity or eligibility
- Not use our services for any unlawful purpose
- Not attempt to gain unauthorized access to our systems or data
- Not interfere with or disrupt the operation of our services
- Keep your account credentials (if applicable) secure and confidential
7. Not Professional Insurance Advice
While we strive for accuracy, we do not guarantee the completeness, reliability, or suitability of any information provided through our AI systems or platform. Insurance decisions should always be verified with a licensed professional. We are not responsible for decisions made based solely on AI-generated information.
No fiduciary relationship, broker-client relationship, or advisory relationship is created by your use of our AI systems. A broker-client relationship is established only when you are connected with and engaged by a licensed human broker.
8. Privacy
Your use of our services is also governed by our Privacy Policy & Notice of Privacy Practices, which describes how we collect, use, and protect your personal and health information. By using our services, you acknowledge that you have reviewed our Privacy Policy.
9. Intellectual Property
All content on the Qdos Health website and platform, including text, graphics, logos, design, and software, is the property of Qdos Health or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without our prior written consent.
10. Disclaimers
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- Our services will be uninterrupted, timely, secure, or error-free
- AI-generated information will be accurate or complete
- Any particular insurance plan, carrier, or rate will be available to you
- Our platform will be compatible with all devices or browsers
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, QDOS HEALTH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to damages for loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your use of or inability to use our services
- Any errors, inaccuracies, or omissions in AI-generated content or guidance
- Any insurance decisions made based on information provided through our platform
- Unauthorized access to or alteration of your data
- Any other matter relating to our services
In no event shall our total liability to you exceed the greater of (a) the amount you paid us in the twelve months preceding the claim or (b) one hundred dollars ($100).
12. Indemnification
You agree to indemnify, defend, and hold harmless Qdos Health, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of our services, your violation of these Terms, or your violation of any third-party rights.
13. Dispute Resolution
We encourage you to contact us first at privacy@qdoshealth.com to resolve any dispute informally. If a dispute cannot be resolved informally, you agree that any claim or dispute arising under these Terms shall be resolved through binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules.
Arbitration shall take place in Hennepin County, Minnesota, or at a location mutually agreed upon. The arbitrator's decision shall be final and binding. Judgment on the arbitration award may be entered in any court of competent jurisdiction.
Class Action Waiver: You agree that any arbitration or legal proceeding shall be conducted on an individual basis and not as a class action, class arbitration, or representative proceeding.
Small Claims Exception: Either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.
14. Termination
We may suspend or terminate your access to our services at any time, with or without cause, with or without notice. You may stop using our services at any time. You may request deletion of your account and associated data by contacting privacy@qdoshealth.com or calling (662) 399-5620.
Upon termination, sections of these Terms that by their nature should survive (including Disclaimers, Limitation of Liability, Indemnification, Dispute Resolution, and Governing Law) will continue in effect.
15. Modifications to Terms
We may modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page and post the revised Terms on our website. Your continued use of our services after changes are posted constitutes your acceptance of the modified Terms.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of law provisions. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the state or federal courts located in Hennepin County, Minnesota.
